DISTRIBUTION AND ACCOUNTING

 

§         Initiating Responding State is responsible for reconciling arrears and collecting current support and forwarding it to the Initiating State

§. Steve – in the two State world toady, doesn’t the Responding State collect the current support and forward to the Init State?

 

§         All Responding States with an arrears balance send all those arrears balances to the Initiating state

 

 

 

 

§         Responding States pursue all enforcement remedies including except Federal Offset, primarily to collect state retainable arrears.  (According to FSA 88, States should not be using FAO if they are the responding state).

 

§         Responding States are responsible for distributing payments to all arrears types, including never and unassigned arrears, and sending money to the family in order to comply with distribution rulesThe Responding State is allowed to enforce its state assigned arrears and pay off those debts first.

 

 

 

§         Initiating State sends arrears payments to Responding states with some discretion, oldest first, in-state arrears first, allocated to all debts, etc. usually after all in-state arrears are satisfied

 

§         Responding State sends updated balances to Initiating State on an as needed basis, usually when going to court or case closure is indicated.

 

 

§         States claiming interest and fees must notify the Initiating states of any balances due in these categories.

 

 

§         Out of state arrears debts do not have assignment information associated with them since the other jurisdiction is responsible for distribution.

§         Responding State is responsible for collecting support and forwarding it to the Case Manager State.Same

 

§         All States with an arrears balance send those arrears balances to the Case Manager state with identification of Permanently and Conditionally assigned arrears that make up the balance.Same – except that the arrears must be identified as assigned and unassigned

 

§         Responding, or another  States pursues enforcement only if requested to do so by the Case Manager State, however, it never includes Federal Offset as an enforcement remedy.

 

§         Responding States with assigned arrears will only be receiving payments allocated to assigned arrears by the Case Manager State.  The Case Manager will be the only state sending money to the family.

 

§         Case Manager State must allocate payments to all debts with assigned arrears, in proportion to the balance of the debts.

 

 

§         Responding State sends updated balances, including assignment information, to Case Manager on a monthly basis to allow accurate accounting and allocation of arrears.

 

§         Same except that the States claiming interest are responsible for sending any updated interest balances to the Case Manager State monthly.

 

§         Case Manger must have  assignment information associated with oOut of state arrears debts.  Federal Offset payments must be allocated to Conditional and Permanently assigned arrears on all debts by the Case Manager State.
